Under what conditions can immigration authorities arrest a U.S. citizen?

Generally speaking, U.S. Immigration and Customs Enforcement (ICE) does not have the authority to arrest or detain U.S. citizens on immigration grounds. However, there are limited and specific circumstances where ICE may interact with or even temporarily detain individuals who are mistakenly believed to be non-citizens subject to removal: 


  • Reasonable Suspicion of Unlawful Presence and Risk of Escape: ICE may detain individuals if they have a "reasonable suspicion" that the person is not a U.S. citizen and that they entered the country illegally and are likely to escape before a warrant can be obtained.
  • Errors in Databases or Documentation: Sometimes, errors in information or contradictory documentation may lead to an ICE agent suspecting a citizen of being an undocumented immigrant, and in such cases, they might be detained pending investigation.
  • Arrest on Criminal Charges: If a U.S. citizen is arrested on a criminal charge and ICE becomes involved, for example, through an immigration detainer, they may be detained and processed through the immigration system while their citizenship is verified.  

Important considerations

 

  • U.S. Citizens' Rights: Even if mistakenly detained, U.S. citizens retain their constitutional rights, including the right to remain silent and the right to an attorney.
  • Seeking Legal Counsel: If you are a U.S. citizen who has been detained or believe you are at risk of being detained by ICE, seeking legal counsel from an experienced immigration attorney is highly recommended to protect your rights and ensure your proper release.
  • Focus of Immigration Enforcement: ICE’s primary focus is on individuals who have violated immigration laws, particularly those who pose public safety or national security threats, according to U.S. Immigration and Customs Enforcement (.gov). 

In summary, while the circumstances are rare and usually involve mistaken identity or criminal charges, ICE may detain individuals they reasonably believe to be non-citizens who entered the U.S. unlawfully and pose a flight risk, even if those individuals are actually U.S. citizens.

 The UCDems July guest speaker was Mr. Bob Kendall from GA ForestWatch. (shown centered in the black shirt). 

Bob provided information and insight on U.S. House Bill 471 "Fix Our Forests Act" which can potentially affect 85% of our Chatahoochee-Oconee NF. The Bill is coordinated with Trumps Executive Order 14225 "Immediate Expansion of American Timber Production".This Bill has passed the House and has moved to the Senate. 


Two primary concerns:


*the National Forest land in and around the Georgia area do not pose the same wildfire risks that exist in the western part of our nation and, 


* the increased timber production directly omits public opinion and input.

He replied, "Yes sir I do."

What can you do to help????


A million thanks to everyone who in some way made it possible to send "get out the vote" postcards to 2400 Union County Voters in March.  We will do it again for all elections.


Before past elections, 

postcards were sent to strong Dems, leaning Dems and Independents to encourage them to vote in upcoming elections.


For the March "Get out the Vote" there were a lot of moving parts and volunteers who made that happen. 


 When the GA Legislature enacted the many revisions to the voting process, it became necessary to let the voters know about the changes.


  • A group of volunteers created a postcard that would showcase those major changes.   
  • The next major hurdle was to purchase enough stamps to mail those cards and many of you stepped up to the plate with generous contributions.  
  • A volunteer printed the labels, and another had the cards printed for March. 
  • The last step was to make packets and have them available for the postcard writers...all 42 of them!  


It's an exciting time for those who participate actively in the political process and getting the message out is so important. Because of your generosity and enthusiasm, we were one step further in putting our message out there. 


Let's all continue to spread the word and let's keep GA blue!
